In case we have asked you permission to use your socia media post, and you have replied with #yesDesperados or by filling out the Desperados UGC form, you agree to the following conditions:

 

You grant Desperados (Heineken Brouwerijen B.V., with registered office and principal place of business at Tweede Weteringplantsoen 21, 1017 ZD, The Netherlands), a non-exclusive, royalty-free, worldwide license to use your photo, visual or moving image (referred to as "User Content") that you posted on Instagram, Facebook, Twitter or YouTube and other social media. After your approval, we can use your User Content for marketing and advertising purposes.

You grant Desperados also the right to use your username, real name, image, likeness, descriptions of you, location or other identifying information, including but not limited to your voice, in connection with any use of your User Content.

This means that we can use your User Content to advertise and promote the Desperados brand in all our advertising, be it on Desperados websites, social media or other. The User Content may be used, reproduced, distributed or combined with other materials, including tweaks and edits.

This license is perpetual, but if you change your mind and withdraw the license, please us know via social@desperados.com. We do not have the obligation to use the User Content, and may remove User Content from our media any time and for any reason, without notifying you.

 

With the permission, you also confirm and agree that:

 

You own all rights to your User Content and you have permission from any person appearing in your User Content to grant the rights therein.

All person(s) appearing in your User Content are above 25 years old.

Your User Content will not violate any intellectual property rights, privacy rights, publicity rights, or other legal rights of any third party. Desperados has the right to disclose your username to any third party that claims that your User Content infringes their rights.

You will not hold Desperados, or any person acting on Desperados’s behalf, responsible for any claims or demands in connection with the use of your User Content.

All your personal data are collected and processed by Desperados with due observance of the Desperados privacy policy https://www.desperados.com/global/en/privacy-policy.

 

We reserve the right to alter these terms and conditions without notifying you, so please check these on a regular basis.
